Why Gerrit and Agnes Springorum Made Their Mutual Inheritance Agreement

This document is a mutual inheritance agreement, a legal arrangement in which two people—here, brother and sister Gerrit and Agnes Springorum—promised that if one of them died first, the survivor would inherit the main part of the estate. It combines a power of attorney for their absence with a "donation in case of death" (donatio causa mortis), meaning a gift that only takes effect if death occurs. Such contracts were meant to prevent disputes, secure property, and make sure the right people would inherit without lengthy court cases.

The agreement was made because Gerrit and Agnes planned to travel for business or family affairs. Travel in the sixteenth century was risky: illness, accidents, or violence could easily lead to death far from home. By arranging administrators for their property and fixing inheritance rules in advance, they protected their goods, paid debts properly, and avoided quarrels among siblings if something went wrong.

For my research, this contract is highly significant. It names multiple members of the Springorum family, clarifies their relationships, and shows how property was meant to pass through the family. It also proves cooperation between siblings and reveals which relatives were favored and which were deliberately excluded. As such, it is not only a legal document, but a key source for reconstructing family structure.

Nachdem der ehrbare und bescheidene Gerhardt und Agnes Springormus, wilne Johans Springorum und Margaretha Bluden, Gott gnade, eheliche Kinder, ihrer Dienste halben und sich etwas zu andern Sachen zu verreisen vorhabens, damit ihnen in ihrem Abwesen in allen und zu gedeckter Kundschaft und guter Verwahrung und Fürgestalt werde, und nicht Zorn gegen geschmachte, haben sie auf heut Datum nachbeschrieben, jedoch an Widerrufungen ihrer herbevor gesetzten und verordneten Curatoren, sich davon bezeugende vor den ehrbaren und vorsichtigen Bürgermeistern und Rat der Stadt Bomcken, zu ihren Procuratoren, Administratoren und Machtboten hiermit gegenwärtiglich die auch ehrbaren und bescheidenen Johann Spruchornen und Reinhardt beswort, ihren frommen, treuen Bruder und respektiven Vetter, samt und besonders, daß dieselben neben und mit beiden Orten ihren gesetzten Curatoren ihre Habe und Güter, beweglich und unbeweglich, wie und wo dieselben gelegen, verwalten, einklagen, verteidigen, verpfänden, verkaufen, quittieren, Schulden bezahlen, Quittungen empfangen und Hypotheken ablösen mögen.

Actum Sonntag, den 14. Januar Anno 1568.

Und alldieweil die beiden Constitueten Gerrit und Agnes, Bruder und Schwester, wie obgemelt zu verreisen bedacht, so sich dann begebe, daß ihrer einer oder sie beide abgingen (das Gott lange wenden wolle), haben sie mit Rat und Willen der Ehrnvesten und Achtbaren Dothmar Beswort und Wessels von der Frumberke, Richter zu Bochum, zu gesetzten und beständigen Curatoren, eine Ordnung und letzten Willen, per donationis causa mortis, also durch Gabe auf den Todesfall, gemacht, wie folgt:

Welcher von ihnen zuerst abginge, der solle dem anderen das zugeteilte Haus und Hof mit Zubehör allein lassen und behalten. Vorab sollen hundert Taler vorweg genommen werden; sodann soll ein jeglicher der übrigen Brüder fünfzig Taler erhalten.

Was nach Zahlung der Schulden des zuerst Verstorbenen übrig bleibt, soll Johann, der älteste Bruder, und seine jetzige Ehefrau, ihre freundliche liebe Schwägerin, zum besseren Fortkommen ihres jetzigen Ehestandes auf ewig haben und behalten, jedoch sollen Herman zuwardt und sein Haus ein Erkentnis oder Vergütung von einem Gulden erhalten und damit abgeschnitten sein.

Wer diese Schenkung nicht halten oder sie anfechten wollte, der solle seiner Gabe verlustig sein und dieselbe Donation als gültig halten müssen.

Darüber haben die beiden Donanten glaubwürdige Zeugen gebeten und durch Bürgermeister und Rat der Stadt besiegeln lassen.

Translation

Since the honorable and respectable Gerrit and Agnes Springorum, lawful children of the late Johan Springorum and Margaretha Bluden (God rest them), intend to travel away for certain affairs, and so that during their absence their property may be safely administered and no disputes arise, they have on this day appointed, before the honorable mayors and council of the city of Bochum, as their legal agents and administrators, the respectable Johann Springorum and Reinhardt Beswort, their faithful brother and respective cousin, to manage all their movable and immovable goods, wherever situated: to administer, collect, defend, mortgage, sell, give receipts, pay debts, receive quittances and redeem pledges.

Done on Sunday, 14 January 1568.

And since the said Gerrit and Agnes, brother and sister, are preparing to travel, and should it happen that one or both of them should die (which God long prevent), they have, with the advice of the honorable Dothmar Beswort and Wessels von der Frumberke, judge at Boncken, made a permanent arrangement and last will by way of a donation in case of death.

Whichever of them dies first, shall leave to the other alone the house and farm with all appurtenances. First, one hundred thalers shall be taken off the top; then each of the remaining brothers shall receive fifty thalers.

What remains after payment of the debts of the first deceased shall go to Johann, the eldest brother, and his present wife, his beloved sister-in-law, for their support in their married state, to have and to hold forever.

However, Herman and his household shall receive a compensation of one gulden and be thereby fully satisfied.

Whoever refuses to accept this gift or attempts to contest it shall forfeit his own gift and must recognize this donation as valid.

For this, the two donors called credible witnesses and had it sealed and confirmed by the mayor and council of the city.
