Barend Springorum acknowledges receipt of a legacy on behalf of Hendrik Schermer

On 19 January 1782, a notarial act was drawn up in Amsterdam recording that Barend Springorum, acting as attorney for Hendrik Schermer, received a legacy of three hundred guilders. The payment was made by Martinus de Neff, the sole surviving executor of the testament of Geertruij Schermer and Barend Schermer, executed in 1769. By this act, Springorum formally acknowledged receipt and granted full and final discharge to the executor, the estate, and the heirs.

Compareerde voor mij Anthony Mylius, Notaris en Translateur, bij den Hove van Holland en door de Ed: Groot Achtb: Heeren Burgemeesteren en Regeerders der stad Amsteldam behoorlyk aangesteld, geadmitteerd en beëdigd, te Amsteldam resideerende, en voor de natenoemene getuigen;

D’ Barend Springorum, wonende binnen deze stad, in qualiteit als speciale gemagtigde van Hendrik Schermer, volgens Procuratie op den 19den Januarij dezes Jaars 1782 ten overstaan van mij Notaris en getuigen getekend;

En bekende hij Comparant in zyne gemelde qualiteit, op het teekenen en passeeren dezes door mij Notaris, van den Heer Martinus de Neff, als vermits het overlijden van Johannes Menting, eenige overgeblevene Executeur van den Testamente van Geertruy Schermer en Barend Schermer, ontvangen te hebben de somma van Drie Honderd Guldens, in voldoeninge van het Legaat van gelyke somma, aan zyn Comparants voornoemde Principaal bij hetzelve Testament (het welk op den 29sten Augustus des Jaars 1769 ten overstaan van den Notaris Gerardus Wythoff en getuigen alhier is gepasseerd) door de Langstleevende der genoemde Testanten, zynde geweest Geertruy Schermer, is gelegateerd;

En mitsdien niet alleen den genoemden Heer Martinus de Neff in zyne voorschreeve qualiteit, maar ook den Boedel en Erfgenaamen van wylen meer genoemde Geertruy Schermer, deswegens finaal en absolut te quiteeren en dechargeeren bij dezen, zonder eenige reserve, met belofte en aanneeminge omme dezelve ten allen tyden en tegen een iegelyk, wegens alle namaninge of aanspraake, uit voorschreeven hoofde, kost- en schadeloos te zullen houden en bevryden, onder renuntiatie van relief en alle andere middelen en benefitien van recht of gratie, die hier tegens zouden kunnen worden bedagt of te stade komen, onder verband als naar rechten;

English Translation

Appeared before me Anthony Mylius, Notary and Translator at the Court of Holland, and duly appointed, admitted, and sworn by the Right Honourable Lords Burgomasters and Governors of the City of Amsterdam, residing in Amsterdam, and in the presence of the hereinafter named witnesses;

Barend Springorum, residing within this city, acting in the capacity of special attorney of Hendrik Schermer, pursuant to a power of attorney executed on the nineteenth day of January of the present year 1782 before me, the Notary, and witnesses;

And the said appearing party acknowledged, in his aforesaid capacity, upon the signing and passing of this instrument by me, the Notary, that he had received from the Honourable Martinus de Neff, as by reason of the death of Johannes Menting the sole surviving executor of the testament of Geertruy Schermer and Barend Schermer, the sum of Three Hundred Guilders, in satisfaction of the legacy of the same amount bequeathed to the aforesaid principal of the appearing party under the said testament (which was executed on the twenty-ninth day of August in the year 1769 before the notary Gerardus Wythoff and witnesses in this city), by the survivor of the said testators, being Geertruy Schermer;

And therefore not only to fully and finally acquit and discharge the said Martinus de Neff in his aforesaid capacity, but also the estate and heirs of the late aforesaid Geertruy Schermer, in respect thereof, absolutely and without any reservation, with promise and undertaking to hold and keep them harmless and indemnified at all times and against everyone, from all claims or demands arising from the aforesaid cause, renouncing relief and all other means and benefits of law or grace that might be devised or invoked to the contrary, under obligation as by law;
