Wij Willem, &c.

Nademaal het den Koning van Groot Brittannië goedgedagt heeft, zonder eenige wettige reeden, den staat deezer landen vijandelijk aan te tasten, dat de Hoog Mogende Heeren Staaten Generaal der Vereenigde Nederlanden derhalven genoodzaakt zijn geworden alles bij te brengen tot derzelver wettige defensie, en teffens te gebruiken het regt, hetwelk aan den staat, door het eigen doen van hoogstgedagten Koning, gegeeven wordt, om reciproquelijk zoodanig te handelen als tegen den staat gehandeld wordt, en vervolgens ook aan denzelven Koning en deszelfs onderdanen alle afbreuk te doen, door en zoo zulks zal kunnen en mogen geschieden.

En dat door Matthijs Ooster, Jan Nicolaas van Eijs en Jan Meschert van Vollenhoven, kooplieden te Amsterdam, als Directeurs van eene Kaaprederije, een schip van oorlog zijnde uitgerust, genaamd de Triton, bemand met honderd en vijftig koppen en voerende twee en twintig stukken geschut, een getrouw, bequaam en wel ervaren persoon om als Capitein daarover te commandeeren, diend gesteld en gecommitteerd; waartoe Ons is gerecommandeerd de persoon van Frederik Johannes van der Biest, Ons verzoekende dat wij hem met onze Commissie daartoe noodig, geliefden te doen voorzien.

Zoo is ’t, dat wij hetzelve, als tendeerende tot afweering van verdere onheilen en tot bevordering van den welstand en veiligheid der gemeene Commercie en Navigatie deezer Landen, in behoorlijke consideratie hebben genomen, en daarbenevens geïnformeerd zijnde van de bequaamheid en vroomheid van den voornoemden Frederik Johannes van der Biest, denzelven tot Capitein van het voorsz. schip gesteld en gecommitteerd hebben, gelijk wij hem stellen en committeeren bij deezen, met last en authorisatie om het voorsz. schip te voorzien van alle zulke officieren en bootsgezellen als hem goeddunken en belast worden zal.

En dat hij voorts, bij retorsie, zal mogen aantasten en neemen alle oorlogscheepen en commissievaarders, als mede koopvaardijscheepen en goederen, onder het gebied van den hoogstgedagten Koning van Groot Brittannië behoorende, of zijne subjecten toekomende, of van daar of elders, op deszelfs bestelling uitvarende of invarende, zonder onderscheid van plaatzen, zoo wel binnen als buiten Europa; wel verstaande dat hij onder praetext van deeze niet zal mogen beschadigen eenige kooplieden of ingezetenen van de meergenoemde Vereenigde Nederlanden, noch de goede vrienden derzelve, of diegenen waarmede dezelve in goede alliantie of neutraliteit zijn.

Ten welken einde hij, Capitein, gehouden wordt zig te reguleeren naar den articulbrief of de ordonnantie, hem voor te houden; gelijk mede alle buit of prijzen die hij zoude mogen veroveren, behoorlijk te leveren in handen van het Collegie ter Admiraliteit, onder welks district hij is uitgevaren, om bij hetzelve wettige kennis genomen te worden van de deugdelijkheid of ondeugdelijkheid van dien, en behoorlijke verdeeling daarvan gemaakt te worden, volgens de ordonnantie daarop gemaakt of nog te maken.

En voorts behoorlijke cautie te stellen voor de Raaden ter Admiraliteit, waar het schip is afvarende, en bovendien een pertinent journaal te houden van zijne reise, en hetzelve, na dat hij ingekomen zal zijn, over te leveren aan het voorsz. Collegie.

Wyders zal hij en zijne officieren uit alle der scheepen die hij zal veroveren, met zig in de Nederlanden brengen den Capitein, opperstuurman en de opperkooplieden, mitsgaders eenige andere officieren; ’t en ware hij die veroverde scheepen hadde ledig en zonder volk vinden drijven. Dog, zoo namaals bevonden wierd dat hij de voorsz. officieren uit hunne scheepen gejaagd, of ergens aan land gezet hadde, in zulken gevalle zullen zoo wel de voorsz. officieren als de voorsz. Capitein, arbitrallijk, of zelfs naar gelegenheid van zake met den dood, zonder eenige genade, gestraft worden.

Op alle ’t welke hij voorts schuldig zal zijn den behoorlijken eed van getrouwheid te doen aan de respective Collegien ter Admiraliteit.

Verzoekende dienvolgende alle Koningen, Republicquen, Potentaaten en andere persoonen, van wat staat, digniteit, ampt en conditie dezelve zouden mogen weesen, den voornoemden Frederik Johannes van der Biest voor onzen Capitein te willen erkennen, en hem dienvolgende alle faveur en goede bevordering te betoonen; ’t welk wij jegens een iegelijk, naar zijne hoogheid, staat en qualiteit, willen erkennen en verdienen.

Ordonneerende en bevelende daarbenevens wel uitdrukkelijk allen oversten, luitenants- en vice-admiraalen, capiteinen, bevelhebbers, en voorts allen anderen in dienst der gemelde Vereenigde Nederlanden en onder onze gehoorzaamheid weezende, den voornoemden Frederik Johannes van der Biest voor onzen bestelden Capitein te houden en te erkennen, en hem in het volbrengen zijner last alle hulpe en assistentie te verleenen.

We, William, etc.

Whereas it hath pleased the King of Great Britain, without any lawful reason, to make a hostile assault upon the state of these lands; and whereas the High and Mighty Lords States General of the United Netherlands have therefore been constrained to bring together all means for their lawful defence, and at the same time to exercise the right which is granted to the state by the very actions of the aforesaid King himself, namely to act reciprocally in such manner as the state hath been treated, and consequently to inflict upon the said King and his subjects all such damage as lawfully may and can be done:

And whereas by Matthijs Ooster, Jan Nicolaas van Eijs, and Jan Meschert van Vollenhoven, merchants of Amsterdam, acting as Directors of a privateering company, a ship of war hath been fitted out, named the Triton, manned with one hundred and fifty men and carrying twenty-two pieces of ordnance; and whereas a faithful, capable, and well-experienced person is required to command the same as Captain, for which purpose there hath been recommended unto Us the person of Frederik Johannes van der Biest, with request that We would be pleased to provide him with Our Commission requisite thereto:

Therefore We, having taken the same into due consideration, as tending to the prevention of further calamities and to the promotion of the welfare and security of the common commerce and navigation of these lands, and being moreover informed of the capability and probity of the said Frederik Johannes van der Biest, have appointed and commissioned him as Captain of the aforesaid ship, even as We do hereby appoint and commission him, granting him full charge and authority to provide the said ship with such officers and seamen as he shall judge fit and shall deem necessary.

And further, that he shall be permitted, by way of reprisal, to attack and seize all ships of war and commissioned vessels, as well as merchant ships and goods, belonging under the dominion of the aforesaid King of Great Britain, or appertaining to his subjects, whether outward-bound or inward-bound, from thence or elsewhere, by his order, without distinction of places, as well within as without Europe; provided always that, under pretext hereof, he shall not damage any merchants or inhabitants of the aforementioned United Netherlands, nor their good friends, nor those with whom they stand in good alliance or neutrality.

To which end the said Captain is bound to govern himself according to the articles of commission and the ordinances that shall be laid before him; and likewise to deliver all prizes or captures which he may take, in due form, into the hands of the College of Admiralty under whose district he hath sailed, in order that lawful cognizance may be taken there of the validity or invalidity thereof, and a proper distribution made according to the ordinances already made or hereafter to be made.

Furthermore, he shall be bound to provide sufficient security before the Councils of Admiralty from which the ship hath departed, and moreover to keep a proper and exact journal of his voyage, and upon his return to deliver the same to the aforesaid College.

Likewise, he and his officers shall bring with them into the Netherlands, from all ships which he shall capture, the Captain, the chief master, and the principal merchants, together with some other officers, unless he shall have found such captured ships drifting empty and without people. But if it should afterwards be found that he hath driven the said officers from their ships, or set them ashore at any place, then in such case both the said officers and the said Captain shall be punished arbitrarily, or even, according to the circumstances of the matter, with death, without any mercy.

Upon all which he shall further be bound to take the proper oath of fidelity before the respective Colleges of Admiralty.

Wherefore We do request all Kings, Republics, Potentates, and other persons, of whatsoever state, dignity, office, or condition they may be, to acknowledge the aforesaid Frederik Johannes van der Biest as Our Captain, and accordingly to show him all favour and good assistance; which We, on Our part, toward every one according to his rank, state, and quality, are willing to acknowledge and deserve.

And We do moreover expressly ordain and command all commanders, lieutenant- and vice-admirals, captains, officers, and all others in the service of the said United Netherlands and under Our obedience, to hold and recognize the aforesaid Frederik Johannes van der Biest as Our appointed Captain, and to afford him all help and assistance in the execution of his charge.
