Compareerde voor mij Nicolaus Brake, Notaris bij den Edele Hove van Holland geadmitteerd, te Amsterdam resideerende, in presentie van de nagenoemde getuigen.

Barend Likman, als jongmatroos gevaren hebbende met het kaperschip de Spion, gevoerd door den Capitein Jan Olhoff, dewelke verklaarde te constitueeren en magtig te maken zijn kaapbaas Barend Springorum, alhier woonachtig, specialijk om in naam en van wegen hem Constituant te vorderen en te ontfangen zodanige portie als hem Constituant, door de koopreederij van voorsz. schip, competeerd in de uitdeelingen die wegens de prijzen, welke bij gemelde kaperschip gemaakt en opgebracht zijn, zullen gedaan worden.

Als mede om de portie die bij Constituant van Dirk Meijer (welke mede als jongmatroos met gedacht kaperschip gevaren heeft) voor vier en dertig Guldens, volgens zeker briefje of intentenis, heeft gekocht, mede te vorderen en te ontfangen; en indien zulks niet konde volgen of gerespecteerd wierd, alsdan van dezelve Dirk Meijer de prestatie van zijn verkoop en des noods dezelve de levering of het behoorlijke instaatstelling en ontfangst van dat prijsgeld te vorderen en, door middel van rechten (zo het nood zij), daartoe te noodzaken.

Op alle ontfangsten te quiteeren en voor ramaning in te staan, des gerequireerd cautie te stellen, in de borgen bevrijding te beloven, ook tot afdoening van arresten of anderszins bij accoord, compromis of transactie te procedeeren, als mede om in rechten te ageeren, domicilium te kiezen, zoo in als buiten rechten.

En ter zake voormeld alles meerder te verrichten wat zal worden vereischt, met macht van substitutie ad lites, alles met beloften van approbatie, onder verband en submissie als naar rechten.

Gepasseerd te Amsterdam, in presentie van Petrus Jacobus Couranck en Jan Hendrik Joosten als getuigen.

Vermits al de minute actens in het protocol van wijlen den Notaris Nicolaas Brake, welke voor hem zijn gepasseerd en door de daarin voorkomende comparanten zijn ondertekend, bij de wet van het tegenwoordig liggende Bataafsche Volk en den Contraact laatstleden 33sten verklaard de kracht en het effect te hebben van notariële acten, welke op een behoorlijke wijze zijn gepasseerd, niettegenstaande dezelve door hem Notaris Brake niet zijn ondertekend; en vermits ik Christoffel Reinier Samuelse, Laernoten te Amsterdam bij den Hove van Holland geadmitteerd, bij gemelde neergelegde gegeven ben, heb mede de voorzegde verklaring op alle zulke minute aantekening te doen vinden.

English Translation

Appeared before me Nicolaus Brake, Notary admitted at the Honourable Court of Holland, residing in Amsterdam, in the presence of the hereinafter named witnesses.

Barend Likman, having sailed as a young sailor aboard the privateer ship De Spion, commanded by Captain Jan Olhoff, who declared that he constitutes and authorizes his kaapbaas_ (privateering agent) Barend Springorum, residing here in Amsterdam, specially and expressly, in the name and on behalf of him the constituent, to demand and receive such share as is due to him the constituent from the commercial ownership of the said ship, in the distributions to be made from the prizes captured and brought in by the said privateer ship.

As well as to demand and receive the share which the constituent has purchased for the sum of thirty-four guilders from Dirk Meijer (who likewise sailed as a young sailor aboard the said privateer ship), according to a certain note or acknowledgment; and if such could not be obtained or respected voluntarily, then to demand from the said Dirk Meijer performance of his sale and, if necessary, to require from him the delivery or proper placing at disposal and receipt of the said prize money, and to compel the same thereto by means of legal proceedings, if need be.

To give receipt for all monies received and to stand security upon demand, to provide caution if required, to promise release of sureties, and also to proceed to the settlement of attachments or otherwise by agreement, compromise, or transaction, as well as to act in legal proceedings, to choose domicile, both in and out of court.

And in respect of the aforesaid matters, to do and perform all further acts that may be required, with power of substitution ad lites, all with promise of approval, under obligation and submission as by law.

Passed in Amsterdam, in the presence of Petrus Jacobus Couranck and Jan Hendrik Joosten as witnesses.

Whereas all the minute acts contained in the protocol of the late notary Nicolaus Brake, which were passed before him and signed by the appearing parties therein, have, by virtue of the law of the presently established Batavian people and the Contract of the thirty-third day thereof, been declared to have the force and effect of notarial acts properly executed, notwithstanding that the same were not signed by the said notary Brake; and whereas I, Christoffel Reinier Samuelse, notary at Amsterdam admitted by the Court of Holland, have been charged by the aforesaid deposit, I have also caused the foregoing declaration to be entered upon all such minute acts.
