Den 14 Decembr: compareerde voor mij Nicolaus Braher, anno 1785 Notaris bij den Edele Hove van Holland geadmitteerd, te Amsterdam resideerende, in presentie van de nagenoemde Getuigen.

De E. Joan Hendrik August Rohters, laatst gevaren hebbende als Chirurgijn met het schip genaamd de Jonge Elias, gevoerd bij Capitein Jan Fredrik Grietke, van Curaçao over Baltimora alhier gearriveerd, staande thans wederom op zijn vertrek om in evengemelde qualiteit als Chirurgijn met het schip Vogelstein, gevoerd bij Capitein Christoffel Spaan, naar Suriname te vertrekken.

Dewelke verklaarde te constitueeren en magtig te maken de E. Barend Springorum, woonende binnen deeze stad, generalijk om van alle en een iegelijk zijner, van zijn Constituants, debiteuren te vorderen en te ontfangen de voldoeninge en betalinge van zodanige actien en pretensien, van welken aard of benaming dezelve zouden mogen weezen, en uit wat hoofde die ook mochten spruiten, geene uitgezonderd, als hem Constituant zijn competeerende.

Met alle en een iegelijk over alle openstaande zaken en pretensien te rekenen en liquideeren, rekeningen te sluiten en naar bevindinge te approbeeren of debatteeren; bij alle voorvallen en zaken en tegen een iegelijk rechtsmiddelen te emploijeeren, ten dien einde te compareeren voor alle Heeren Rechters, Hoven en Rechtbanken, alle rechtstermijnen te observeeren, vonnissen, appoinctementen en dispositien te verzoeken en ter executie te leggen, of des geraden daarvan te appelleren, te provoceren of te reformeren; apprehensien en arresten te doen, die te vervolgen en wederom te ontslaan.

Alle gerequireerde en noodig zijnde cautien te stellen, in de borgen bevrijding te beloven; ook bij accoord, compromis en transactie te procedeeren; op alle ontfangsten te quiteeren en voor namaning (des noods) te caveeren; domicilium citandi et exsequendi te kiezen.

En bij alle voorvallen zijn Constituants persoon te representeeren, en generalijk zoo in als buiten rechten alles verder en meerder te verrichten wat vereischt zal worden, en hij Constituant zelve present zijnde zoude kunnen, mogen en moeten doen, ofschoon een ampelder of specialer volmacht wierd noodig geacht, welke hij Constituant verklaarde te houden ten dezen voor geinsereerd; met macht van substitutie, alles onder beloften van approbatie en verband als naar rechten.

English Translation

On the 14th of December appeared before me Nicolaus Braher, in the year 1785 Notary admitted at the Honourable Court of Holland, residing in Amsterdam, in the presence of the hereinafter named witnesses.

The Honourable Joan Hendrik August Rohters, who had last sailed in the capacity of Surgeon aboard the ship called De Jonge Elias, commanded by Captain Jan Fredrik Grietke, arriving here from Curaçao by way of Baltimore, and who now stands again upon his departure in the same capacity of Surgeon aboard the ship Vogelstein, commanded by Captain Christoffel Spaan, bound for Suriname.

Who declared to constitute and appoint the Honourable Barend Springorum, residing within this city, generally and without limitation, to demand and receive from all and every one of the debtors of him the Constituant full satisfaction and payment of such actions and claims, of whatsoever nature or denomination the same might be, and from whatsoever cause they might arise, none excepted, as lawfully belonging to him the Constituant.

With authority to reckon and liquidate with all and every person concerning all outstanding matters and claims, to close accounts and approve or contest the same as occasion may require; to employ all legal remedies in all occurrences and matters against any person whatsoever; and to that end to appear before all Lords Judges, Courts and Tribunals, to observe all legal terms, to request judgments, orders and dispositions, and to cause the same to be executed, or, if deemed advisable, to appeal from, provoke or reform the same; to cause attachments and arrests to be made, to pursue or to release the same.

To provide all cautions required or necessary, to promise the release of sureties, likewise to proceed by agreement, compromise or transaction; to give receipt for all monies received and to stand for demand (if need be); to choose a domicile for citation and execution.

And in all occurrences to represent the person of his Constituant, and generally, both in and out of court, to do and perform all such further and additional acts as may be required, and as he the Constituant himself, if personally present, could, might, or ought to do, although a fuller or more special power of attorney might be required, which he the Constituant declared to be hereby fully inserted; with power of substitution, all under promise of approval and obligation as by law.
